USE OF THIS APPLICATION CONSTITUTES YOUR ACKNOWLEDGMENT THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. In return for accepting the terms of this agreement, in order to use this Application, you (hereinafter "you"), agree as follows:

License. NRCA grants you a personal, non-transferable, and nonexclusive license to use the EnergyWise Roof Calculator application (the "Application"), in accordance with the terms and conditions of this agreement. You may not modify, adapt or, translate the Application. You may not decompile, disassemble, reverse engineer or otherwise reduce the data files that comprise the Application to human-perceivable form.
Ownership. All rights in and to the Application including, but not limited to, copyrights and trademarks, belong to NRCA and PIMA. The license granted above is not a sale, and this agreement does not give you any rights to copyrights, trademarks, or patents with respect to the Application.
Termination. This license is effective until termination in accordance with this agreement. You may terminate the license at any time. In addition, the license will terminate immediately if you fail to comply with any of the terms or conditions of this agreement. All other terms and conditions of this agreement, including, without limitation, provisions relating to disclaimers of warranties, limitations of liability, remedies or damages, and NRCA and PIMA's proprietary rights, shall survive any termination of the license.
Disclaimer. The Application has been designed to allow the user to determine the minimum insulation requirements for roofs, calculate and compare annual energy usage costs for various roof assemble configurations, and verify the placement of a membrane vapor retarder within roof assemblies. Calculations are based upon accepted industry procedures. NRCA and PIMA assume no responsibility for the accuracy or suitability of calculations for particular projects or any decision made by you in connection with the use of the Application.
Limited Warranty. NRCA does not warrant that the information contained in the Application will be accurate, or that your system will operate without interruption. EXCEPT AS PROVIDED ABOVE, THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND THE ENTIRE RISK TO THE QUALITY AND PERFORMANCE OF THE APPLICATION IS WITH YOU. IN NO EVENT WILL NRCA, PIMA, ITS AGENTS, CONTRACTORS, SPONSORS OR AFFILIATES BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY DIRECT DAMAGES IN EXCESS AMOUNTS PAID FOR THE APPLICATION OF FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, ANY LOSS OF DATA, OR LOSS OF PROFITS, OR LOST SAVINGS, ARISING OUT OF THE USE OF THE APPLICATION.
General. You acknowledge that this agreement is the complete and exclusive agreement between NRCA, PIMA and you relating to the Application, and that this agreement supersedes any other agreements, proposals, discussions or other communications, oral or written, relating to the Application. This agreement shall be governed by the laws of the United States of America and the State of Illinois. You may not assign, transfer or otherwise convey your rights or duties under this agreement, and any such assignment, transfer or conveyance is void and of no force and effect.
